Regarding Andhra Pradesh State Council of Higher Education
The assets of APSC of the undivided State of Andhra Pradesh, that is, assets existing up to the date of bifurcation may be divided between the two successor States in the population ratio of 58:42, as provided under Section 2(h) of the Re-organization Act, 2014
Why the LIABILITIES has been excluded in the judgement while all provisions of Andhra Pradesh Re-Organization Act – 2014 said the distribution applies to Assets and Liabilites.
Also another notable miss is the Order does not include the need for Andhra Pradesh state to Adopt APSC under Andhra Pradesh State Council for Higher Education Act, 1988 as required under section 101 of AP Re-Organization Act – 2014, which it is yet to do creating legal hassles in division of employees, assets and liabilities which is the root cause of the crisis precipitated by Andhra Pradesh as Telangana State adopted TSC and initiated everything as per the act in wide Letter No.263/UE/2014-2 dated 05.09.2014 which APSC has ignored and even diverted the cash in the account to the residuary state without consent of TSC.
